Terms of Use
Last updated 27 October 2026
The short version. Be 16 or over. The membership renews until you cancel, and cancelling takes two taps in your store settings. DC gives general fitness information, not medical advice. Be decent in Crew. Your rights under Australian Consumer Law always apply.
1. About these terms
These terms are an agreement between you and DARCYCO, a sole trader in Australia (ABN to be added), trading as DARCYCO Studio (“we”, “us”). They cover the DARCYCO Active app and this website (together, the “service”). By creating an account or using the service you agree to them, along with our Privacy Policy, Health & Safety information and AI Disclosure. If you downloaded the app from the App Store or Google Play, their terms also apply to that download.
2. Who can use it
You must be 16 or older. If you are under 18, you confirm a parent or guardian is aware you use the service. Some features (physique and goal-photo analysis, targets below maintenance calories, a public profile by default) are not available under 18. Please give accurate details, including your birth date, and keep your sign-in secure.
3. Health
The service provides general fitness, stretching and nutrition information. It is not medical advice and does not replace a doctor, physiotherapist or dietitian. Check with a health professional before starting if you have a medical condition, injury, are pregnant, or answered yes to any readiness question. Stop if you feel pain, dizziness or chest symptoms. You choose what you do and at what intensity. Read Health & Safety.
4. Active Membership
- Price. Active Membership is A$14.99 a month or A$99.99 a year in Australia, including GST. Prices in other countries are set in local currency. The price shown in the app before you subscribe is the one that applies.
- Free trial. New members get a 7-day free trial on either plan, once per person. We remind you 2 days before it ends. Unless you cancel at least 24 hours before the trial ends, it converts to a paid membership and you are charged by Apple or Google.
- Payment. You pay through Apple In-App Purchase or Google Play Billing, and their payment terms apply. We never see or store your card details.
- Auto-renewal. Your membership renews automatically at the end of each month or year, at the then-current price, until you cancel. Renewal is charged within 24 hours before the period ends. If the price goes up, we and the store will tell you in advance and you can cancel before it applies.
- Cancelling. Cancel any time in your App Store or Google Play subscription settings, or from Me → Settings → Manage membership in the app. Deleting the app does not cancel the subscription. After you cancel you keep membership until the end of the period you have paid for, then you keep the free tier and all your data.
- Refunds. Because payments are taken by Apple or Google, refund requests go to them under their policies (Apple: reportaproblem.apple.com; Google: the Play Store order history). We cannot issue store refunds directly, but email support@darcyco.com.au and we will help. Nothing in these terms limits your rights under the Australian Consumer Law.
- Changes to features. We may improve, change or remove features. If we remove something central to the membership, we will tell you and you can cancel.
5. Active Points and shop perks
Active Points have no cash value, cannot be transferred or sold, and can be redeemed only as described in the app. Earning rules, caps and redemption values are shown in the app and may change with notice. Points earned through cheating or fake activity can be removed. Shop discounts apply to DARCYCO Home & Body under its own terms of sale.
6. DC, the AI coach
DC is an AI system. Its suggestions are generated automatically, can be wrong, and are not reviewed by a person before you see them. Use your judgment, use the easier option when unsure, and stop if something hurts. You can turn DC off. See the AI Disclosure.
7. Crew rules
When you post, comment or message in Crew, you agree not to:
- harass, bully, threaten, shame or target anyone, including about their body, weight or appearance;
- post hateful content about race, ethnicity, religion, disability, gender, sexuality or any other attribute;
- post nudity, sexual content, or any content involving minors in a sexual or exploitative way;
- promote eating disorders, extreme restriction, self-harm, or the use of steroids, prohibited substances or unsafe supplements;
- give or sell medical treatment, or sell anything, without our permission (no spam, scams or affiliate links);
- post someone else's photo or personal information without their permission, or impersonate anyone;
- post content you do not have the right to share, or break any law;
- scrape, reverse-engineer, overload or try to get around the security or paywall of the service.
8. Moderation
Every post and profile has Report and Block. We review reports and may hide content, remove comments, restrict features, or suspend or close accounts that break these rules, usually without notice where safety requires it. We aim to act on serious reports within hours. If you think we got it wrong, email support@darcyco.com.au and we will look again. We may report illegal content to the authorities, including the eSafety Commissioner.
9. Your content
You own what you create and upload. You give us a non-exclusive, worldwide, royalty-free licence to host, store, display and process it only so we can run the service for you and show it to the people your settings allow. This licence ends when you delete the content or your account, except where others have already re-shared it inside the app or we must keep it by law. We do not use your content to train AI models and we do not use it in marketing without asking you first.
10. Our content
The app, its design, the DARCYCO name and logos, exercise and stretch illustrations, routines, recipes and text are owned by us or our licensors. You may use them for your own personal training. Do not copy, resell or redistribute them. Food data includes information from Open Food Facts (Open Database Licence) and other sources credited in the app.
11. Gym listings and prices
Gym details and prices come from public sources and from users, and may be out of date. Check with the gym before you join. We are not responsible for a gym's services. If you submit a price, it must be true to your knowledge.
12. Australian Consumer Law and our liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill and be fit for their stated purpose. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law or any other law that cannot be excluded.
To the extent the law allows, and apart from those guarantees: we provide the service “as is”; we are not liable for indirect or consequential loss; and where our liability for a failure to meet a guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again. We are not liable for injury that results from ignoring the health information in the app, training through pain, or failing to seek medical advice where it was recommended, except to the extent caused by our negligence. Consumers in other countries keep the rights their local law gives them.
13. Suspension and closing your account
You can delete your account at any time (see account deletion). Deleting your account does not cancel a store subscription; cancel that in your store settings first. We may suspend or close an account that seriously or repeatedly breaks these terms. If we close your account without a good reason related to your conduct, we will refund any unused prepaid membership where we can.
14. Changes to these terms
We may update these terms. If a change matters, we will tell you in the app or by email at least 14 days before it takes effect. If you do not agree, you can cancel and delete your account before then.
15. Law and disputes
These terms are governed by the laws of Victoria, Australia. If you have a problem, please email support@darcyco.com.au first so we can try to fix it. You can also contact your local consumer protection agency. Courts in Victoria have jurisdiction, without taking away any right you have to bring a claim where you live.
